Agreement to Terms

By accessing or using Heartfelt ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

You must be at least 13 years of age to use the Service. By using the Service, you represent that you are at least 13 years old.

Description of Service

Heartfelt is a wedding thank-you note assistant that provides:

  • Gift tracking -- organize and manage wedding gifts and givers
  • Voice-to-text -- record voice memos that are transcribed into text
  • AI note generation -- generate personalized thank-you note drafts based on your gift and guest information
  • Credit system -- AI-generated notes are powered by a credit-based system

Accounts

  • You are responsible for maintaining the security of your account and password
  • You must provide accurate and complete information when creating your account
  • Each account is intended for use by one couple
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account

AI-Generated Content

  • Thank-you notes generated by Heartfelt are suggestions only and are intended as a starting point
  • You are responsible for reviewing, editing, and verifying all generated content before sending
  • Heartfelt is not liable for any errors, inaccuracies, or unintended content in AI-generated notes that are sent without review
  • You own the final version of any notes you create, edit, and send using the Service

Voice Recording

  • By using the voice recording feature, you consent to your audio being recorded and processed
  • Voice audio is sent to the Google Gemini API for transcription
  • Audio data is processed in real time and is not stored on our servers after transcription

Credits and Payments

  • AI note generation uses a credit-based system
  • Credits are purchased through Stripe payment processing
  • All credit purchases are final and non-refundable
  • We reserve the right to change pricing at any time, with reasonable notice
  • Any unused credits remain available in your account indefinitely

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Use automated tools to scrape, crawl, or extract data from the Service
  • Send spam, bulk messages, or unsolicited communications through the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Impersonate any person or entity
  • Upload or transmit viruses, malware, or other harmful code

Intellectual Property

  • Heartfelt and its original content, features, and functionality are owned by Heartfelt and are protected by applicable intellectual property laws
  • You retain ownership of all personal data you provide to the Service, including guest information, gift details, and your final edited notes
  • By using the Service, you grant us a limited license to process your data solely for the purpose of providing the Service to you

Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

Limitation of Liability

  • The Service is provided "as is" and "as available" without warranties of any kind, either express or implied
  • We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components
  • To the maximum extent permitted by law, Heartfelt shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim

Service Availability

  • We strive to provide reliable access to the Service, but we do not guarantee 100% uptime
  • We may modify, suspend, or discontinue any part of the Service at any time, with or without notice
  • We are not liable for any modification, suspension, or discontinuation of the Service

Account Termination

  • You may delete your account at any time from the Settings page in the app
  • We reserve the right to suspend or terminate your account if you violate these Terms
  • Upon termination, your right to use the Service ceases immediately
  • We may delete your data after account termination in accordance with our Privacy Policy

Changes to Terms

We may update these Terms of Service from time to time. When we do, we will update the "Last Updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the updated terms.

We encourage you to review these Terms periodically.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in California.
